Two CMPD officers who shot and killed a man in uptown Charlotte in November will not be charged.
District Attorney Spencer Merriweather said in a report Friday that officers Kevin Lovell and Shane Matthews were justified in firing the shots that killed Treon McCoy after McCoy shot another man.
McCoy, 33, died and another man was injured during the incident, which happened about 2:15 a.m. Nov. 15 at the Epicentre shopping and dining complex.
According to the D.A.'s report, officers Lovell and Matthews heard gunshots and went to the corner of East Trade Street and South College Street where they found McCoy fighting with the second man. McCoy had a 9-mm. handgun and had shot the second man in the leg, and he appeared ready to fire again at him, according to the D.A.'s office.
The officers ordered McCoy to drop the gun, and when he didn't they fired, hitting McCoy three times.
The report says the incident was captured by security cameras, and that video was among the evidence used to decide whether to charge the officers. The State Bureau of Investigation also investigated.
Merriweather noted that his decision "does not address issues relating to tactics, or whether officers followed correct police procedures or CMPD directives."
