Family Of Danquirs Franklin Files Lawsuit Against City Of Charlotte, Officer

The family of a man killed by a CMPD officer outside a west Charlotte Burger King is filing suit against the city of Charlotte and the officer involved. 

The family of Danquirs Franklin is accusing the city and Officer Wende Kerl of negligence in his death, and of violating his Fourth Amendment rights. Witnesses say Franklin had entered the fast food restaurant in March armed with a handgun, where he attempted to confront an employee he suspected of having a relationship with the mother of his children.

 

When officers arrived, Franklin was outside the restaurant kneeling beside a car with the restaurant’s manager. He was shot by Officer Wende Kerl as he appeared to remove the handgun from his waistband.

 

The suit argues he was following officers’ repeated commands to drop his weapon. The police department is declining to comment on the suit.
