The trial date for Rayquan Borum, the man accused of fatally shooting Justin Carr during protests following the 2016 shooting of Keith Lamont Scott, has been set for February 11.
The trial was originally scheduled to begin on December 3.
According to an attorney for Borum, the date was changed due to the upcoming holiday season.
“We were not sure we would be able to complete the trial before Christmas,” Darlene Harris said, touching on the possibility of the trial lasting more than two weeks. “We didn’t want to have to start the trial and then stop the case as the holidays are observed, so it was moved to February 11.”
Borum is accused of firing a weapon in front of the Omni Hotel during demonstrations after the Scott shooting. Carr, 26, was participating in that protest and was hit by a bullet -- Borum is accused of firing that fatal shot.
Borum has been held in the Mecklenburg County jail for more than two years. He was denied a bond hearing on two occasions.
A second motion for a bond hearing for Borum was denied in April. Because of Borum's representation by a different attorney as well as additional witnesses, his attorneys said they felt he should have been granted a hearing.
They would not give any information on the new witnesses, saying it was confidential and would not be revealed until the trial.
Harris maintained that position this week, saying only that, “We are putting in our best effort.”
When asked about Borum’s state of mind, Kannady said, “It’s difficult for anyone to be away from their family for the holidays and this is his second time missing the holiday season with his.”
