The state insurance commissioner is calling on Blue Cross and Blue Shield of North Carolina CEO Patrick Conway to resign after video related to Conway's DWI arrest emerged and news broke that the insrance giant suspended its merger with an Oregon company.
"There is no path forward to have a trusting, confident and reliable working relationship with the chief executive officer of Blue Cross Blue Shield," Insurance Commissioner Mike Causey said Wednesday at a news conference in Gastonia.
Causey's comments come a day after news outlets published the video – and a day after Blue Cross and Blue Shield suspended its merger with Cambia Health Solutions.
Video appears to show Conway driving erratically for several miles on Interstate 85 in June before he side-swiped a tractor-trailer.
Conway was charged with driving while impaired and misdemeanor child abuse. Police say his daughters were in his vehicle.
A police report obtained by WRAL-TV quotes Conway as telling police that he would call Gov. Roy Cooper and quote “get you in trouble.”
Conway refused a breathalyzer test.
"Dr. Conway showed a lack of professionalism, respect and composure for law enforcement officers and the legal process," Causey said.
Conway has since undergone treatment at a 30-day inpatient program, according to Blue Cross Blue Shield’s chairman.
Causey said Wednesday that the Blue Cross board had "misrepresented" the nature of Conway's arrest to his office, leading him to believe it was "routine."
"This arrest, as the news account showed yesterday, was anything but routine," Causey said.
Meanwhile, Washington state’s insurance commissioner sent a letter to Cambia’s board of directors saying that Blue Cross Blue Shield had a legal obligation to inform him of any material change to Conway’s biographical affidavit as part of the merger approval process.
Kreidler said Blue Cross should have notified him immediately and had a “legal obligation” to inform him within two business days of “any material changes” to Conway’s biographical affidavit.
Blue Cross Blue Shield and Cambia announced their intentions to merge in March.
