WFAE’S Amplifier Guitar Sweepstakes - Official Rules

  1. PROMOTION DESCRIPTION; SPONSOR: The WFAE Amplifier Guitar Sweepstakes ("Sweepstakes") begins on August 9, 2019 at 12:00:01 AM ET and ends on September 4, 2019 at 9:00:00 PM ET (the "Promotion Period"). The sponsor of this Sweepstakes is University Radio Foundation, Inc. d/b/a WFAE ("Sponsor"). By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes. Sponsor may be reached by email at membership@wfae.org during the Promotion Period.

  2. ELIGIBILITY: Open to residents of the United States who are 18 years or older at the start of the Promotion Period, or if under 18, who have a parent or legal guardian accept the Prize for them if they are not of age (the “Entrant”). Current or former employees of Sponsor, their Immediate Family Members, and/or Household Members are not eligible to enter or win a prize. “Household Members" shall mean those people who share the same residence as Entrant. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses of Entrant. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

  3. PRIZE: Grand Prize: One (1) winner will receive 1 Fender Special Edition Deluxe Ash Telecaster Maple Fingerboard Aged Cherry Burst Acoustic Guitar (approximate retail value or "ARV": $549.99 to $ 700.00 (exact ARV depends on shipping charges))(the “Prize”). The Prize cannot be transferred, redeemed for cash or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if the prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the Prize represents Sponsor's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the Prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Sponsor will not replace any lost or stolen prize items. Sponsor will arrange for delivery of the Prize to the winner once the winner has been verified and confirmed as the winner. This Sweepstakes is open to residents of the United States and the Prize will only be delivered to an address within the United States. All federal, state and/or local taxes, fees, and surcharges, and any other costs or expenses incurred in claiming or using the Prize, which are not expressly described in the Prize description in these Official Rules, are the sole responsibility of the prize winner. Failure to comply with the Official Rules may result in forfeiture of the Prize.

  4. HOW TO ENTER: Enter the Sweepstakes during the Promotion Period by one of two ways: (a) by emailing membership@wfae.org with your name, email address, and physical address together with a request to enter this Sweepstakes or (b) by registering online for a ticket to the Ken Burns’ Documentary Preview Event (“Event”). There is no cost to register or attend the Event. Register at the event website at (https://www.eventbrite.com/e/ken-burns-country-music-documentary-preview-tickets-68342204373). Attending the Event is not a condition to entering or winning this Sweepstakes. Each registrant to the Event, who is otherwise an eligible Entrant under these Official Rules, will receive one (1) entry in the Sweepstakes, or enter during the Promotion Additionally, persons who are “sustaining members” in Sponsor’s records by the start of the Promotion Period will automatically be entered in this Sweepstakes to the extent they meet the eligibility requirements for Entrants, provided that no donation is required to enter this Sweepstakes and anyone eligible can enter by email for free as indicated above. Limit one (1) entry per Entrant regardless of means of entry. Duplicate attempts to enter will be void. Odds of winning are the same, regardless of method of entry.

Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant's Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be received by the end of the Promotion Period in order to participate. Sponsor's database clock will be the official timekeeper for this Sweepstakes.

5. WINNER SELECTION: The winner of the Sweepstakes will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period, regardless of means of entry. The random drawing will be following the end of the Promotion Period and may require drawing more than one (1) potential winner if the Entrant drawn is ineligible or declines the Prize. Odds of winning will vary depending on the number of eligible Entries received.


  1. WINNER NOTIFICATION: Potential winner will be notified by email at the email address provided in the individual’s entry. Potential winner must respond to initial attempt to contact him/her within 48-hours or Sponsor may elect to draw an alternate potential winner. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or failure to adequately monitor any email account. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign, have notarized and return an affidavit of eligibility and release of liability and publicity as well as sign a IRS Form W-9 (Request for Taxpayer Identification) (collectively the “Prize Claim Documents"). Failure to return the Prize Claim Documents in the proper form and in the timeframe requested by Sponsor, which will not be less than five (5) business days, may result in forfeiture of the Prize. Sponsor reserves the right to verify the winner in any manner determined by Sponsor, including by requesting to see the individual’s address and age in a current driver’s license.

  2. PRIVACY: Personal information supplied to Sponsor will be visible to EventBrite, which provides the Event website, to the Whitewater Center hosting the Event. By entering the Sweepstakes, you grant Sponsor permission to use your personally identifiable information for the purpose of administration and prize fulfillment, including use in a publicly available winner list. If Sponsor, EventBrite, or the Whitewater Center send you any marketing messages, you may elect to opt-out from within the email.
  1. LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes.

If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor shall not have any further liability to any participant in connection with the Sweepstakes.
EventBrite and the Whitewater Center are not sponsors of this Sweepstakes, which is not affiliated with or endorsed by them.


  1. DISPUTES: If any part of these Official Rules is deemed to be invalid or otherwise unenforceable or illegal, the balance of the Official Rules shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Except where prohibited, Entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a federal or state court located in Mecklenburg County, North Carolina.; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
  1. WINNER LIST/OFFICIAL RULES: To obtain a copy of the Winner List or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to WFAE 8801 J.M. Keynes Drive, Suite 130 Charlotte, NC 28262. Requests for the names of the winners must be received no later than December 4, 2019.
