Judge Denies Temporary Halt To I-77 Project

Superior Court Judge Osmand Smith III on Thursday denied a request by the anti-toll group Widen I-77 to delay the NCDOT’s I-77 widening project north of Charlotte.

The decision came after a day-long  hearing Tuesday at state Superior Court in Alamance County.

The ruling means the project can go forward while the court hears the anti- toll group’s request for a permanent halt .

In a statement on its website the group said it was disappointed, but would push for the permanent injunction.

“Today we were informed Judge Oswald Smith III denied our motion for a preliminary injunction.  We are obviously disappointed, but respect the judge’s decision. A preliminary injunction would have stopped the toll project entirely.  Our request for a permanent injunction remains active, and we will be meeting with counsel and as a group to discuss.”
