Federal energy regulators have rejected Duke Energy's appeal for a longer license to operate dams and reservoirs along the Catawba River. This week's decision by the Federal Energy Regulatory Commission, or FERC, keeps the license term at 40 years, instead of the 50 years Duke had requested.
FERC granted the 40-year license last November. Duke appealed in December, asking for a re-hearing. The utility argued that because of the expense of improvements planned, it should get the longer term. On Monday, FERC issued an order denying the request.
In its re-licensing application, Duke agreed to donate and preserve land and to give money to state agencies to buy land and protect wildlife.
Duke says it's reviewing Monday's order. The company has 60 days to accept it or challenge it in court.
