Agent Who Killed Suspect At Charlotte Nightclub Won't Be Charged

The Mecklenburg County District Attorney's Office says a federal Department of Homeland Security special agent acted in self defense last year when he shot and killed a suspect outside a North Tryon Street nightclub. 

In a 293-page report, D.A. Spencer Merriweather says special agent Jose Dugger will not be charged in the shooting death of 30-year-old Donald Janvier.

Dugger, of the Homeland Security gang unit, was working along with state Alcohol Law Enforcement agents at Tropix Bar & Lounge on August 25, 2018.

According to the report, Janvier came out of the club with a weapon, got into his car, and then drove into the agent. Dugger fired back and killed Janvier.

In the report's conclusion, Merriweather said: "It would be impossible for the State to prove that Special Agent Dugger did not act in self-defense."
